General Terms and Conditions (GTC) of the Gygax Retail AG Online Store
Gygax Retail AG only fulfills online store orders from Switzerland and Liechtenstein. For international shipments, please contact our customer service department at +41 32 397 00 77.
The currency generally used for the online store is CHF.
1. General Terms and Conditions
These General Terms and Conditions apply to all purchases or use of services via the Gygax Retail AG website, specifically www.bijoulesboutiques.ch (hereinafter referred to as the “website”). Online product offers are valid only as long as they are displayed on the website and while supplies last. The images displayed on the website are for illustrative purposes only and are not binding. Exceptions may apply to individual products (one-of-a-kind items), in which case the actual product is shown. The information and descriptions provided in catalogs and brochures (flyers) are for explanatory and visual purposes only and are not binding. Gygax Retail AG disclaims all liability for any errors or inaccuracies in connection with the aforementioned images, diagrams, explanations, catalogs, leaflets, or the website.
2. Orders, Shipping Terms, Exchanges, and Returns
An order becomes final only after it has been accepted by Gygax Retail AG. By placing an order, customers fully and unconditionally accept these General Terms and Conditions (GTC), to the exclusion of any other provisions or conditions that may otherwise apply.Gygax Retail AG reserves the right to reject orders from customers.
2.1. Delivery
When placing an order, customers can enter their preferred shipping address. This may differ from the billing address. The following shipping options are generally available:
• Delivery to the address of your choice
• Delivery to a Bijou les Boutiques store
Delivery typically takes 2–4 business days from the time the order is placed. Depending on the product and circumstances, delivery may be delayed.
Items delivered to a Bijou les Boutiques location must be picked up within 10 calendar days. Ordered merchandise that is not picked up within 10 calendar days will be returned to the central warehouse. The order will be canceled.Please note the respective store hours whenpicking up your order.
2.2. Returns
It is the customer’s responsibility to inspect the merchandise immediately upon delivery and to report any defects or discrepancies from their order. The customer may return defective merchandise, or items that do not fit or are not to their liking, within 14 calendar days without providing a reason. For the purpose of calculating the 14 calendar days, the date the customer receives the package and the postmark on the return shipment are decisive. The return must be made in the original packaging and include the enclosed packing slip. Only unworn, clean, undamaged, and complete merchandise, including all attached labels, will be accepted for return in the original Bijou les Boutiques packaging. Clothing without a Bijou les Boutiques price tag is considered worn and will not be accepted for return. Customers are responsible for shipping costs in the event of a return. Upon receipt of the goods,Gygax Retail AG will inspect the returns and determine whether they are in perfect condition and eligible for a credit. The refund will be issued via the same payment method used for the original purchase. Only the value of the goods will be refunded. Any shipping costs incurred will not be credited.

All items may be returned within the specified time frame, provided they have not been used or worn. The customer should keep the proof of mailing, as this serves as evidence in the event that the package is lost. Once the return period has expired, the purchase is considered final. Excluded from the right of return are used items, items ordered or custom-made according to specific requests, and items withoutthe original price tag attached.
In addition, customers are free to return the products they ordered to any of the existing stores. To do so, they must return the item in question in its original Bijou les Boutiques packaging, along with the return form included with the order. The purchase price will not be refunded until the online store receives the merchandise at the return address.
2.3. Refunds
If customers exercise their right to return an item, the amount charged will be refunded via the original payment method, unless the conditions listed under “Returns” have not been met. For returns shipped from one of our stores, the refund will be processed only after the merchandise has arrived at the return address. This process may take a few days.
Since the online store and Bijou les Boutiques use different point-of-sale systems, Bijou les Boutiques cannot issue cash refunds.
2.4. Shipping Costs
Orders under CHF 80.00 are subject to a shipping fee of CHF 4.90. Shipping is free for orders of CHF 80.00 or more.
Orders placed at Bijou les Boutiques always include free shipping.
Bulky items (furniture such as cabinets, shelves, tables, armchairs, etc.) can be picked up free of charge at our warehouse at Hauptstrasse 37 in 2572 Sutz, or delivered to your home address for a flat-rate shipping fee. To calculate the applicable shipping costs, we ask customers to contact us.
3. Payment Terms and Payment Confirmation
3.1. Payment Methods
The price stated on the order confirmation will be billed. The list of accepted payment methods is subject to change. Accepted payment methods are those currently available and selectable in the online store, which typically include real-time payment methods (credit card, TWINT, Postfinance). Gift certificates and member vouchers can also be redeemed online.
3.2. Order Confirmation
Every order and every change will be confirmed to customers via email. By placing an order, customers agree to these Terms and Conditions and the prices listed. Gygax Retail AG reserves the right to cancel even orders that have already been confirmed. In this case, the buyer will be promptly refunded the full purchase amount.
3.3. Provisions Leading to Termination of the Contract
If the customer fails to fulfill any of his or her obligations, or fulfills them only in part, Gygax Retail AG reserves the right to suspend all deliveries or terminate the current contract.
4. Ownership and Damages—Retention of Title
4.1. Ownership
The goods remain the property ofGygax Retail AG until full payment has been made.
4.2. Damages
Claims for damages arising from errors in illustrations, prices, and text, or from delayed or failed delivery, are strictly excluded.
5. Bijou Member
"Bijou-Member" is the loyalty program of Bijou les Boutiques, managed by Gygax Retail AG, headquartered in 2572 Sutz, Switzerland.
As Bijou members, customers earn Bijou points on their purchases, which are redeemed as member gift cards once they reach a certain point balance. Membership gives customers access to offers, services, events, and more organized by Bijou les Boutiques. You’ll receive digital receipts for your purchases at Bijou les Boutiques and online, and you can view your past purchases, current point balance, and member gift cards in your Bijou account.

6. Data Protection and Data Transfer
The data necessary for processing transactions is stored and shared with affiliated companies as part of the order fulfillment process. All personal data is treated confidentially. The stored address data may also be used for promotional purposes within Gygax Retail AG. The customer authorizesGygax Retail AG to store and analyze customer purchase history. However, the data will not be disclosed to third parties. If the customer does not consent to the storage of their personal information, they must informGygax Retail AG immediately so that the data can be deleted.Gygax Retail AG does not have access to credit card numbers, nor are they stored or saved in the system.
6.1. Secure Transmission
Confidential data, such as bank account information and credit card numbers, is transmitted via www.wallee.com using a secure transmission method. This means that this data is securely encrypted before transmission.
6.2. Google Analytics
The website www.bijoulesboutiques.ch uses Google Analytics, a web analytics service provided by Google Inc. Google Analytics uses so-called cookies. These cookies are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookies regarding your use of this website (including your IP address) is transmitted to a Google server in the United States and stored there. Google will use this information to evaluate your use of the website, to compile reports on website activity forGygax Retail AG, and to provide other services related to website and internet usage.Gygax Retail AG uses the information received from Google Analytics to continuously improve the website and tailor it to customer preferences. 7. Governing Law and Jurisdiction
The legal relationship between the customer andGygax Retail AG is governed by Swiss law. The exclusive venue for all disputes is 2560 Nidau, Switzerland.
